- General Conditions
This document regulates the conditions under which you can benefit from the services that we offer. By making a reservation or by benefiting from the services that we offer, you agree to these terms and conditions.
The services offered by the Provider include: accommodation.
Haita Land is a resort consisting of three accommodation units, two of which allow children (Pridvor, Străjer) and one (Sihastru) where we do not advise clients to bring children, as there are a few possible hazards for them: unsecured fire stove, unsecured ladder, unsecured sleeping area. All of the accommodation units at Haita Land are designed on the idea of open space and they all have sleeping areas on the upper level, which may pose a threat to children. We do not prohibit the presence of children at Haita Land, however we advise clients to consider these dangers carefully before making a reservation.
Reservation policy
All bookings for the Haita Land resort will have to be fully paid for, at least seven days before the day of arrival. In order for a booking to be confirmed, clients will have to pay the total cost of their reservation. Cancellations of reservations are not accepted, however the dates of the stay can be modified as needed, in some exceptional cases. There will be NO reimbursements or modification of dates for any cancellations announced thirteen days before arrival day, or later.
After confirming them, reservations can only be changed with the express consent of Haita Land. Requests to modify bookings that have not been approved by Haita Land do not entitle the client to a partial or full refund of the price paid.
Haita Land reserves the right to refuse any reservation, without any restriction, without compensation, on a discretionary manner, before the reservation is confirmed.
Haita Land reserves the right, for justified reasons, to cancel any confirmed reservation, with the obligation to refund the amounts paid in advance, in which case the customer will have no right to make any claim or request any compensation for any damage thus suffered.
In case the client does not arrive at the resort on the date of arrival stipulated in the reservation, they are not entitled to be refunded the amount paid in advance.
In case the client leaves the resort earlier than the date of departure stipulated in the reservation, they are not entitled to be refunded any amount paid in advance and the client is not entitled to any compensation or discount.
Payment methods
All payments must be made in advance, by online payment. Payments in cash at the time of check-in are NOT allowed or accepted. Payment with holiday vouchers is not possible.
Payment for additional accommodation services and services provided during the stay will be made online, before the time of check-out, unless the parties have agreed differently.
Accommodation details
Check-in
Access to the property is allowed starting from 4:00 PM on the first day of stay. The clients will have to self check-in, by retrieving the key to their accommodation unit, from a box at the resort’s barrier gate. Two days before check-in, the clients will receive an email containing all check-in details and the four-digit code that can be used at the box, in order to retrieve the key to the unit. The clients are asked to return the key to the same box, at check-out.
Check-out
Check-out is until 12:00 AM on the last day of stay. The clients will return the key to the same box that they have retrieved it from, using the same code that they’ve used for check-in.
At check-in, clients will come into the possession of a key for the accommodation unit which they have booked, and a remote for the barrier gate that is located at the entrance of the resort. Clients are asked to take care of these two items. If the key and/or remote is lost or damaged by the clients, during their stay, then the clients will have to bear the replacement costs, which are as follows:
50 RON for each key to the chalet;
100 RON for each remote for the barrier gate.
Meals
As of now, no meals are included in the accommodation price, unless stated otherwise when booking the reservation. Our restaurant is set to open soon, so we will announce any changes.
Pets
Pets are allowed within the resort perimeter, only with the written or spoken confirmation from Haita Land, before arrival day. Clients are responsible to contact Haita Land in advance and announce their intention of bringing a pet to the resort. The Sihastru cabin has a NO PETS policy. We allow pets at Pridvor and Străjer.
- Prohibitions and responsibilities
Failure to comply with the Haita Land rules referred to in this document or which have been made known to the client by any other means, or by committing any acts which may affect the safety and security of the client, other guests or their property, Haita Land staff or collaborators or the property of the resort, entitles Haita Land to immediately cancel the client’s reservation and request that the client leave the resort.
The following activities are also prohibited within the Haita Land resort:
- Removing objects from the chalets;
- Excessive alcohol consumption or drug use;
- Smoking in the interior of the chalets, or within 10 m of any of them;
- Discarding cigarettes, butts or other rubbish in locations other than those specially arranged;
- The use of personal audio systems (including portable speakers, high telephone volume, etc.).
Haita Land expressly disclaims any liability for the drinking water quality of the spring from which the resort is fed, which cannot be tested constantly.
Haita Land assumes no responsibility for any interaction with wildlife, insects, venomous snakes, which can penetrate the property or poisonous vegetation. Guests expressly assume the obligation to be vigilant and confirm that they have been notified of the existence of these types of hazards, specific to mountain areas.
Haita Land assumes no liability for loss, theft or damage suffered by the guests’ property.
Haita Land does not offer deposit services for guests’ personal belongings.
Any person present on Haita Land property is liable for any damage caused to the property, to the representatives, the staff of Haita Land, or to other guests, and is required to fully repair the damages in accordance with the applicable laws.
For the safety of our guests, the staff, and the integrity of the resort, in the event of a breach of contract of the Haita Land rules, if any person behaves inappropriately or is intoxicated, exhibits aggressive behavior, disturbs the other guests of Haita Land, then they will be immediately asked to leave or be escorted from the premises, their contract being terminated, without the right to be reimbursed the amounts of money paid or to claim compensation for the damage thus suffered.
Clients will take care not to leave any minors unattended in the resort.
The client is liable for all damages caused to Haita Land or to a third party, either by fault or with intent, to their companion or to a person under the client’s responsibility. This liability also applies if the person who suffered the damage is entitled to claim compensation directly from Haita Land.
Haita Land assumes responsibility for any damages caused to the client, which occur within the resort, directly from its fault or its employees, and undertakes to repair the damage thus suffered and proven.
Haita Land will not be liable for any actual, possible, or future damage that did not occur out of its exclusive fault.
Haita Land is not liable for damages, injuries in these spaces, or if the warnings and recommendations displayed by the accommodation are violated.
The client is obliged to notify Haita Land immediately of any damages and to provide all necessary data that may clarify the circumstances of the occurrence of the damage event, or that may be necessary for the investigations.
Each guest is responsible for personal belongings as long as they are in his possession and under his supervision (including in rooms intended for accommodation). Haita Land will be liable for valuables, securities, and cash only if it has taken over specifically for retention or damage has been done for reasons why, according to general rules, it is responsible. In this case, proof falls within the guest’s obligation.
4. Accommodation guarantees
If we are unable to perform the services stipulated in the agreement, out of our fault (e.g. overbooking, temporary operating problems) Haita Land will return to the client the amount of money paid for services that they have not received.
Haita Land assumes no responsibility for any other expenses or situations arising from the cancellation of the reservation by the accommodation.
If the client does not comply with the obligation to pay for the services purchased during the stay, which they have received, or which they have ordered, but have not benefited from them, the provider has the right to retain as a temporary guarantee, the personal items of the client, which they have brought to the accommodation, in accordance with the provisions of the Civil Code.
5. Force majeure
Force majeure constitutes that cause or circumstance (e.g. war, fire, flood, adverse weather conditions, power outage, strike), the intervention of which the Contracting Party cannot control (force majeure), exempts either party from the obligations arising from the contract until such causes or circumstances are maintained.
The parties agree to take all necessary measures to minimize the possibility of such causes and circumstances and to remedy, as soon as possible, the damage or delays arising therefrom.
In view of the actual location of our resort, Haita Land disclaims any liability for any case of objective impossibility of operation of the resort, of providing the necessary utilities, in case of fortuitous or force majeure that would affect the provision of services to guests. The parties shall qualify as a case of force majeure any external event which leads to the impossibility of the full or partial operation of the resort, including, but not limited to, extreme weather events, floods, riots, epidemics or pandemics, war, any measures of local or central authorities prohibiting or limiting the operation of the resort. Other cases which are assimilated to the case of force majeure are the entering into force of local or national administrative measures or the entry into force of legal rules which make it impossible or excessively expensive to provide the services assumed by Haita Land, including, but not limited to, significant restrictions on the operation of accommodation establishments.
6. Change of terms and conditions
We reserve the right to modify, change or update these terms and conditions at any time without prior notice. We recommend that you check this document regularly to be aware of any changes. The changes will take effect within one day of their publication on the site without prior notice. By using our services without express objection, you consent to the new changes.
